Lexington Estate Planning Attorney

A well-executed estate plan is a gift to your loved ones, making their lives easier at a time of great sadness and minimizing the burdens which the probate process puts on families. While most understand the importance of having an estate plan in place, many people overestimate the difficulty of putting in place such a plan, or do not know where to start.

In the Boston metro area, I, Michael F. Brewster, am here to guide you through the process of drafting the wills, trusts, and other legal documents which constitute a good estate plan, and to use my expertise to explain them to you in plain English (as opposed to "legalese"). Together we will approach your plan holistically to account not only for property you may own but also for life insurance, retirement accounts and other financial instruments. As a Lexington estate planning lawyer, I work with individuals and families to learn about their unique circumstances, provide options, and draft and execute the legal instruments which will accomplish their goals.

Estate planning is an important tool in tax planning as well as for easing the probate process. In Massachusetts, planning for tax efficiency in the passing of estates, wills, trusts and other assets is an important consideration no matter your age or financial position. While estate planning may be far from the thoughts of many young people, the earlier such planning is undertaken the more potential benefits may be realized.

Massachusetts Will and Trust Lawyer

The purpose of planning now is to minimize your estate's exposure to the notoriously inefficient and expensive probate process. Though the courts try their best, they are understaffed and overworked, so a well-executed estate plan will attempt to keep as much of your estate out of probate as possible.

Additionally, not having the right documents in place can create tedious and frustrating legal difficulties. As a small example, a law called HIPAA is meant to protect the privacy of your medical information, but often has the unintended effect of keeping medical information from one's family. These are the sort of difficulties good estate planning avoids.

A will is the foundational document of any estate plan, but there are other basic documents which every estate plan should feature. A power of attorney grants decision-making capabilities concerning one's property and other rights to a family member or friend, which becomes very helpful in cases of mental incapacity. A health care proxy grants a loved one with the legal ability to make health decisions on your behalf when you cannot make such decisions yourself. Additionally, trusts can be used creatively to provide for fast and tax-efficient passing of your estate and other assets, so those who survive you get their inheritance much more quickly.
